0.18 Breath - suspension, DUI and all other charges gone!

Our client was stopped September of 2005 for weaving and speeding 33mph over the limit (almost twice the speed limit in this case). She admitted drinking, cooperated with the officer and took all offered roadside tests including the Preliminary Breath Test. In the officer’s estimation, she failed all tests. She was arrested and submitted to an evidentiary breath test resulting in a 0.18 breath result. That's more than double the legal limit. The suspension was rescinded and dismissed because we acted fast, forcing a time limitation on the State they couldn’t comply with. The DUI and all other charges were dismissed based on a technicality that is often missed and even more often misunderstood.
