My Client drove his motorcycle to a bar with his wife on the back. After a few drinks he noticed it was about to rain so he drove the motorcycle home to get the truck. On his way back to the bar he was stopped by a DUI Enforcement Officer for weaving out of his lane. The client didn't look good on video and blew twice the legal limit. This was his fourth DUI so the stakes included serious jail time and a lifetime revocation of his license if convicted.
Our investigation uncovered facts supporting a motion to suppress based on the lawfulness of the stop. Following a three hour hearing the court granted our motion to suppress all evidence gathered after the stop agreeing that the stop was unlawful. With no evidence remaining the prosecutor was forced to dismiss the case. Bottom line: client didn't go to jail and kept his license and never had to see the inside of the courtroom.
